Real estate related agreements are only enforceable if
they’re in writing. Period.
Verbal agreements, handshakes, and “men of their word”
mean very little when it comes to real estate law.
That’s because when there is a disagreement with an
arrangement that's not in writing, it’s very difficult,
if not impossible, to prove which side is right.
Therefore, make sure every detail, every promise, and
everything else involving the deal is in writing and
signed by all parties.
Has the seller agreed to include that beautiful
chandelier with the home? Get it in writing! Did the
buyer agree to not bother you about problems he found
after an inspection? Get it in writing!
Even when dealing with family and friends, this practice
will help protect you from loosing money to forgetful,
dishonest, or mind changing people.
